WE WILL OCCUPY AUSTIN, NOW LETS OCCUPY CAP METRO

Below is a summary of the FTA complaint against Capital Metro. Please note the new content, not posted before: "EMERGING SERIOUS CIVIL RIGHTS CONCERNS/VIOLATIONS". Clearly, Cap Metro's master is the DownTown Business Alliance; CMTA management has a new montra, (expressed by Elaine Timbes), - "We will run Metro like a business". Corporate greed and benefits to developpers motivate our transportation, which contradicts why Capital Metro exists in the first place.

CMTA/Its Board Will Inevitably Allow Abuse of Disabled Paratransit Passengers to Continue

The following article clearly demonstrates that one of the two bidders for the new gestapo eligibility process soon to be forced on Travis county disabled paratransit passengers, is not the kind of company Austin wants. However, recently resigned MetroAccess director, Inez Evans, would most certainly approve of this company since the sole purpose of the new functional assessment process is to kick passengers off the paratransit system.

Wrongful Death Lawsuit Waiting to Happen

As you read the folowing news story, please remember the hundreds of illegal paratransit denials and those passengers who MetroAccess has forced to attempt to ride fixed route because its director illegally imposed conditions on their paratransit eligibility that were not correct. And also please remember that the majority of CMTA board members recently approved a new eligibility process that the facts clearly show MetroAccess is not equipped to properly implement.

Introduction:

MetroAccess Knowingly Places Hundreds of Disabled Paratransit Passengers at Risk

The following is an excerpt from an affidavit submitted to the FTA. It proves conclusively, and beyond a shadow of a doubt, that the current MetroAccess director, who has recently announced her resignation, is responsible for the hundreds of wrongful conditional determinations listed below. However, the CMTA board was also informed of these violations, yet, typically, they prefered to only believe CMTA, as if their words were the writ of God, instead of investigating and correcting the violations as a competent board would do.

MetroAccess Director Responsible for Wrongful Paratransit Denials

CMTA Board Advised of Illegal MetroAccess Paratransit Denials but THEY DID ABSOLUTELY NOTHING

Following is a March 2010 resolution from the Access Advisory Committee, written by my Special Mentor, Diane Bomar, presented to the Capital Metro Board of directors. It describes the civil rights violations in the MetroAccess paratransit eligibility process. Instead of the CMTA board taking action, they merely believed MetroAccess management and the CMTA audit report that claimed no civil rights violations existed.

Request for Texas Attorney General Opinion

The following 7-page document is my request for an opinion by honorable Texas Attorney General Greg Abbott concerning the January 2010 illegal MetroAccess policy to discontinue the provision of paratransit service to the homes of disabled residents in 4 outlying areas.

CMTA MetroAccess: Wrongful Paratransit Eligibility Process

The following evidence was submitted to FTA in December 2010. (Due to privacy concerns, I have not posted the 3 attached analysis reports for Wrongful paratransit Denials, Wrongful Conditional determinations and Wrongful Appeals decisions. However, the following cover letter will, I hope, convince the public that MetroAccess is incapable of implementing board-approved changes to our eligibility process: mainly that MetroAccess will find and educate a third party contractor to perform questionable functional assessments for the Austin paratransit population.

Does CMTA MetroAccess Believe In Civil Rights for the Disabled? If you believe the answer is "yes" please read on

The following is a complaint I submitted to the Federal Transit Administration, Civil Rights Department, June 2010. The ADA team at the FTA has asked if I can provide proof to substantiate this complaint. I have submitted several major updates, one of which contains over 50 pages pertaining to the illegal eligibility process for CMTA MetroAccess. My evidence has been corroborated by a director of another paratransit agency as well as a consultant to the FTA. Presently, I am finalizing an update containing DOT ADA violations in the recently submitted CMTA ADA Paratransit Plan.
